NewIf you can't ban it

Sat, 04/01/23

What you might do if you can't ban gender transition for minors outright is to eliminate the statutes of limitations for suing doctors who perform them, especially if done on minors. The rates of regret and "I want my body parts back" are high enough so that it would wreak havoc on that area of "medicine".

And to be honest, I think that judges are far more likely to allow an arbitrarily long statute of limitations than they are an outright ban in a lot of states, and the long statute of limitations would impose a lot of discipline--you wouldn't be as likely to skip steps aimed at answering "does this person really want this, and will this really be the best therapy for this person's disorder?".

Don't get me wrong; I'm glad Kentucky has done this. I just don't know how well it will stand up with judge-shopping for activist judges.

Aspiring to be a stick in the mud.
